GENERAL CONTRACT TERMS AND CONDITIONS

Preamble

For further development of tourism in the town of Makó, Tourist Association of Makó and Its Region in cooperation with Accommodation Providers and System Acceptance Places has worked out a complex discount system (henceforth: “System”), the detailed rules of which, including the way and possibilities of using the website www.hellomako.hu , are set in these general terms and conditions (henceforth: “GTC”).

Only the members of Tourist Association of Makó and Its Region are entitled to use the website.

By registering on the website, the registrant accepts the rules described below. Admission to the Association is a pre-request for approval of the registration.

All the members of the Association acknowledge that, to the extent permitted by the law, these general terms and conditions can be unilaterally amended in the manner and to the extent prescribed by law.

These terms and conditions contain the rules and the conditions of the services and use of the www.hellomako.hu website, as well as the rights and obligations of the Association and Accommodation Providers.

1. Legal Declaration

The website www.hellomako.hu is the Association’s own developed unique software, all its versions, the disposal rights over it and their property rights and all their partial licenses and their property rights are fully and exclusively the property of the Tourist Association of Makó and Its Region.

The Association does not charge any fees for the use of the www.hellomako.hu website, but its use is conditional upon joining the Association and maintaining membership.

2. GTC, Scope of Data Protection Information

The validity of these General Terms and Conditions and the data protection information covers the Association, Accommodation Providers and Buyers establishing any legal relationship with the previous ones (including private individuals, legal entities, and any other form of economic organisation) who use the discounts provided within this System.

The validity of these GTC does not extend to other discounts provided by any Accommodation Provider outside the System, as well as to possible partners of the Accommodation Providers.

A contract between the Contracting Parties is established upon approval of the registration. After registration, Accommodation Providers are entitled to offer discounts to their guests within the System. Registration is conditioned by acceptance. The registration is approved by the President of the Association.

3. Concept Definitions

Accommodation providers: Any business that is a member of the Association, regardless of its legal form, and whose activity is aimed at accommodating guests and tourists coming to Makó Town and Its Region.

Acceptance place: Any business that is a member of the Association, regardless of its legal form, and undertakes to provide a discount within this discount system.

Discount: A reduction in price, provided by Accommodation Providers and Acceptance Places within this System, compared to their effective price list.

GTC: General Terms and Conditions

Customer, Guest:Any private or legal person who uses the services of an Accommodation Provider or Acceptance Place.

4. Terms of Use, Procedure for Granting the Discount, Registration

The use of the www.hellomako.hu website and the granting of discounts within the System can only take place after registration. Prior to registration, the Accommodation Provider must submit a membership application to the Association. The membership application is approved by the President of the Association.

Registration takes place on the www.hellomako.hu interface. During registration, the registrant chooses a unique username and password. The registration request is approved by the President of the Association.

The condition for granting the discount is that the Guest has to book accommodation for at least one night with an Accommodation Provider that is a member of the Tourist Association of Makó and Its Region. After the arrival of the Guests, the respective Accommodation Provider records the reservation and the number of booked guest nights on the www.hellomako.hu interface. After that, the Accommodation Provider logs in on the admin interface of www.hellomako.hu , from which it sends a time-limited QR code to the Guest via e-mail, as well as a list of Acceptance Places, with the amount of the discount provided by the Acceptance Places indicated. The QR code is valid for the time interval of the actual stay specified by the guest, after that discounts cannot be redeemed with the QR code. In all case, the legality of handling the personal data of the Guests falls under the responsibility of the Accommodation Provider. The Acceptance Places indicate in advance to the President of Association the extent of the discount they wish to provide, as well as the duration of the discount. The amount of the discount is valid until it is modified or withdrawn. The President of the Association shall be informed about the modification of the discount or its withdrawal no later than 7 days in advance at the e-mail address kapcsolat@makoregio.hu .

5. Creation, Validity and Termination of Contract

After the acceptance of these GTC and the registration, a contract is created between the registering Accommodation Provider and the Tourist Association of Makó and Its Region for an indefinite period of time.

All the Accommodation Providers acknowledge that these GTC can be unilaterally modified at any time, without justification, in the case that the conditions specified by law exist, with prior notification.

6. Cancellation of Registration

Registration is cancelled upon expressed request. The request for cancellation must be addressed to the President of the Association, to the e-mail address kapcsolat@makoregio.hu . Registration is not subject to approval. After receiving the request, the President of the Association will take care of the cancelling the registration. By cancelling the registration, the contract between the Accommodation provider and the Association is terminated.

7. Advertising

All Accommodation Providers are entitled to advertise the discount provided within this System. The costs of advertising are fully assumed by the respective Accommodation Provider. All the disputes and complaints that may arise are entirely the responsibility of the respective Accommodation Provider.

8. Technical Information, Surface Maintenance

For the annual maintenance of the www.hellomako.hu interface, 72 hours of scheduled maintenance per year can be used free of charge. The maintenance of the surface is the responsibility of the Association, in connection with which all emerging costs are assumed by the Association. The President of the Association must inform the Accommodation Providers and Acceptance Places via e-mail at least one week in advance of the planned maintenance period. The planned maintenance usually takes place at night, between 10 p.m. and 5 a.m.

If unplanned, exceptional maintenance is necessary, the President of the Association will take care of the maintenance immediately.

9. Liability Issues

The Association excludes its responsibility in the case that, due to exceptional maintenance of the System, the e-mail with the QR code cannot be sent to the Guest.
